1. Scope of Application of the General Terms and Conditions (GTC)
These General Terms and Conditions (GTC) govern the mutual rights and obligations between us as the provider and you as the buyer/service recipient and apply to all purchase agreements concluded through our online shop, accessible at https://www.bikeschool-amade.at/, as well as through verbal and manually created purchase agreements, and for the services offered, such as courses, training, guided tours, and packages. The sale and the entire (contractual) transaction are based exclusively on these GTC in their respective valid version at the time of the order. All deliveries and services of Bikeschool Amade based on online orders via the internet or other online services are subject to these terms and conditions.
The operator of this online shop and provider and seller of the products and services presented is Bikeschool Amade, Brandstattweg 10, 5603 Kleinarl. This operation establishes a potential contractual relationship.
By submitting an order or booking, you as the buyer expressly agree to the application of these GTC to your order or booked service. Oral collateral agreements are not valid. All agreements, collateral agreements, or assurances must be recorded in writing or expressly confirmed in writing by an authorized representative of Bikeschool Amade.
2. Conclusion of Contract
The products and services displayed in our online shop are merely an invitation for you to make a binding offer by submitting a booking or order to us.
The language of contract, ordering, and business is exclusively German.
Bookings can be made by completing and submitting the online form in the online shop or by entering a manual booking.
By clicking the "order with obligation to pay" button in the online shop, you declare that you are making a binding order for the goods and services listed in the "shopping cart." Your order constitutes a binding offer to us to conclude a purchase contract for the goods and services ordered by you in accordance with these terms and conditions. Your offer becomes effective once the order is received by us. You are bound to your offer for a period of 14 days from the receipt of your order. We are not obligated to accept your offer.
Upon receipt of your order, you will receive an automated acknowledgment of receipt, which does not constitute acceptance of your order.
The purchase contract is only concluded when we send you a shipping confirmation or an invoice for the service to the email address provided by you. If you do not receive the confirmation or the invoice – for example, because you have not provided a (valid) email address – the purchase contract is concluded upon execution of your order – that is, upon delivery of the ordered goods to our shipping partner. A contract for the specified service is concluded at the latest upon commencement of the service.
In the event that we cannot accept your offer, for example, because a service is already fully booked or an item is not available, we will contact you immediately and inform you of this circumstance.
3. Participation Requirements for Services
The participation requirements and prerequisites can be found in the respective service.
4. Delivery and Transfer of Risk for Services and Movable Items
All information regarding the availability of services is for guidance only. When purchasing movable items, shipping usually takes place within 2-4 days.
The delivery of movable items takes place upon receipt of your payment in the system of our payment provider or upon receipt of payment into our account.
The delivery of the products and goods, for which the purchase contract is valid according to point 2.6 of these terms and conditions, takes place on working days during normal business hours to the delivery address provided by you. You, as the buyer, are responsible for all costs incurred as a result of incorrect or incomplete delivery addresses.
In the event that we are in default of delivery and are responsible for it, you can withdraw from the contract after setting a deadline of at least 3 weeks. In this case, liability for additional damages is limited in accordance with point 9.
The delivery of the products and goods, for which the purchase contract is valid according to point 2.6 of these terms and conditions, is carried out by a delivery service selected by us in our best judgment. By placing your order, you expressly agree to the dispatch by this carrier.
You bear the risk of accidental deterioration or loss of the goods ordered by you from the time of delivery of the goods ordered by you to you or to a third party named by you who is not the carrier.
5. Prices
All prices are final prices in euros (EUR or €) and include the statutory value-added tax of 20%. This is already included in the prices displayed on the website.
6. Payment Terms
The purchase price is due for payment immediately after the conclusion of the purchase contract for the service or the movable item.
You have the option to pay for your ordered goods and services using the payment methods listed in the ordering process. Payments in advance must be made within 14 days, unless the service period falls within this period. Payment is in any case due at least 1 day before the start of the event.
Regardless of the time of receipt of payment, Bikeschool Amade is entitled to a pro rata purchase price for short-term bookings falling within the cancellation policy period in case of non-attendance or cancellation of the booked service.
7. Right of Withdrawal, Withdrawal Period, Consequences of Withdrawal, and Exclusion of the Right of Withdrawal for Consumers within the meaning of § 1 Consumer Protection Act
If you, as a consumer within the meaning of § 1 Consumer Protection Act, have concluded the purchase contract, you have the right to withdraw from the purchase contract with us (Bikeschool Amade, Brandstattweg 10, 5603 Kleinarl, info@bikeschool-amade.at) within 14 (fourteen) days without giving any reason and to revoke it. Exceptions apply to services under point 7.4. The 14-day withdrawal period begins only on the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods (delivery of the goods to you or the third party named by you, who is not the carrier). If partial deliveries are made by us, the withdrawal period begins only on the day on which you or a third party named by you, who is not the carrier, have taken possession of the last delivered goods or the last partial delivery or the last piece.
To exercise your right of withdrawal, you must inform us (Bikeschool Amade, Brandstattweg 10, 5603 Kleinarl,) of your decision to withdraw from the purchase contract with us and to revoke it by means of a clear statement (e.g., a letter sent by post or an email to info@bikeschool-amade.at). To meet the 14-day withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Withdrawal or cancellation of the service can also be made by Bikeschool Amade, the conditions can be found in point 8 (withdrawal, termination, and exclusion by Bikeschool Amade).
